Obama's Immigration Reform May Live Again Under Hillary Clinton

While the court has chozen three dozen cases for this term, more attention is on who's on the bench rather than facing it.

The Supreme Court Monday dealt another blow to the Obama Administration's programs easing immigration deportations, refusing to rehear the case, USA v. Texas, that the court decided in June.

The justices split 4-4 on the case in June.

Frustrated by Congress's repeated failure to pass immigration reform, Obama in November 2014 issued a decree that would have allowed some 4 million undocumented migrants who have lived in the United States since at least 2010, have no criminal record, and have children who are citizens apply for legal residency.

The prosecutors' request for Supreme Court review addressed two main questions: whether the Wisconsin Supreme Court had been too lax in policing coordination between candidates and independent groups, and whether two state Supreme Court justices who had benefited from campaign spending should have recused themselves. Justice Antonin Scalia's death in February left the court with only eight members, and several 4-4 decisions left major issues unresolved.

Over the past four decades, we've heard at various times that Roe v. Wade and abortion rights are at stake in various cases and political contests.

The court is set to hear cases from North Carolina and Virginia, where Republican lawmakers are accused of setting election boundaries so that black voters are concentrated in a few districts to strengthen the Republican Party in surrounding areas. "Legal experts across the board agree that a rehearing was not only appropriate, but necessary, in USA v. Texas. Attempts to pass immigration reform were made during the Obama administration, unsuccessfully, as Congress has been highly divided on immigration issues".

The most closely watched case set for oral arguments this week comes on Wednesday, when the court will hear an insider trading case that could make it more hard for prosecutors to bring such charges.

"The inability of the Supreme Court in this situation to reach a decision and put forward a ruling has a negative impact on millions of people in the United States", White House spokesman Josh Earnest told reporters, calling on Senate Republicans to confirm a ninth justice.

"Today's decision is not a big surprise, and it means it will be up to the next administration to determine how to deal with the undocumented issue", said Justin Storch, manager of agency liaison at the Council for Global Immigration, an affiliate of the Society for Human Resource Management. "This court instead should be the final arbiter of these matters through a definitive ruling".
